Welcome to Moventra ("Moventra", "we", "our", "us"). These Terms of Service ("Terms") form a legally binding agreement between you and Moventra and govern your access to and use of the Moventra website, applications, APIs, and related services available through moventra.app and associated domains (together, the "Service").

By creating an account, accessing, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Service.

These Terms apply to all visitors, registered users and others who access the Service.

You must be at least 13 years old, or the minimum age required by law in your jurisdiction to consent to the processing of your personal data, whichever is higher. If you are under the age of majority in your country, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

If you use Moventra on behalf of an organization, you represent and warrant that you are authorized to bind that organization to these Terms, and "you" refers to that organization.

By using the Service you represent that you are not barred from receiving it under the laws of any applicable jurisdiction.

To access certain features you must create an account. You agree to provide accurate, current and complete information and to keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must keep your password confidential and must not share your account with others.

You must notify us immediately through our contact page of any unauthorized use of, or access to, your account, or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your credentials.

We may refuse registration, reclaim usernames, or reserve addresses (including any address on the moventra.app domain) at our discretion.

Moventra provides tools to track movies, television series, seasons and episodes; build watchlists and personal collections; view statistics and viewing history; discover recommendations; follow other users and use community features; and access APIs and integrations where available.

The Service relies on metadata, artwork, trailers and ratings sourced from third-party providers. Availability, accuracy and completeness of that information are not guaranteed and may change at any time.

We are continuously developing the Service and may add, change or remove features without notice.

The Service allows you to create, submit and store content, which may include ratings, reviews, comments, watchlists, profile information and user-generated collections ("User Content"). You retain all ownership rights in your User Content.

By submitting User Content you grant Moventra a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, cache, reproduce, display, adapt and distribute that content solely as necessary to operate, provide and improve the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party or violate any law.

We do not claim ownership of your User Content, but we may remove or restrict any content that violates these Terms or applicable law.

You agree not to misuse the Service. In particular, you may not: harass, threaten, defame or abuse others; publish unlawful, hateful, sexually exploitative or infringing content; upload malware or malicious code; attempt to gain unauthorized access to any system, account or data; probe, scan or test the vulnerability of the Service; circumvent rate limits, access controls or security measures; scrape, crawl or harvest data beyond authorized limits; manipulate ratings, rankings, statistics or recommendations; create accounts by automated means; impersonate any person or organization; or use the Service to send unsolicited communications.

You are responsible for your conduct and for complying with all applicable laws and regulations while using the Service.

The Service and all materials it contains, including software, source code, design, layout, text, graphics, logos and the Moventra name and branding, are owned by Moventra or its licensors and are protected by copyright, trademark and other intellectual property laws.

Except for the rights expressly granted to you in these Terms, no right, title or interest in the Service is transferred to you. You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of any part of the Service unless permitted by law or with our prior written consent.

The Service displays information, images, ratings, trailers and metadata obtained from third-party providers and may link to or integrate with third-party websites and services. All copyrights, trademarks and other intellectual property in such content remain with their respective owners; Moventra claims no ownership of it.

We are not responsible for the availability, accuracy, content or practices of third-party services, and your use of them is governed by their own terms and policies.

You may choose to connect third-party accounts (for example, to import your viewing history). By connecting an account you authorize us to access and process information from that service in accordance with our Privacy Policy and the third party's terms.

You may also sign in using a third-party identity provider such as Google ("social login"). When you do, you authorize that provider to share basic profile information with us to create or access your account, and your use of that provider remains subject to the provider's own terms and privacy policy. You are responsible for keeping any third-party account you use to sign in secure.

You can disconnect a connected account, including Google, at any time from your settings. If your account has no password when you disconnect Google, we will email you a link to set one so that you keep access. Disconnecting may remove access tokens but does not necessarily delete data already imported.

Where Moventra provides API access, API users must respect published rate limits, not abuse or overload our systems, not redistribute data in violation of third-party licensing, and follow the published API documentation.

API access is provided at our discretion and may be throttled, suspended or revoked at any time, with or without notice.

Some features may be offered as part of a paid plan ("Plus"). Where paid features are available, the applicable price, billing cycle and features will be presented to you before purchase.

Unless stated otherwise or required by law, payments are non-refundable. We may change pricing prospectively; changes will not affect the current paid period already purchased. You are responsible for any taxes associated with your purchase.

Statutory consumer rights, including any right of withdrawal under applicable EU/Netherlands law, are not affected by this section.

We may offer features identified as beta, preview or experimental. Such features are provided "as is", may be changed or removed at any time, and may be less reliable than generally available features. Your use of them is at your own risk.

We do not guarantee that the Service will be uninterrupted, secure or error-free. We may modify, suspend or discontinue any part of the Service, perform maintenance, or introduce limitations at any time.

We will make reasonable efforts to provide notice of material changes that significantly affect your use of the Service where practicable.

We may suspend or terminate your account or access to the Service, in whole or in part, if you breach these Terms, if required by law, or to protect the Service, our users or third parties.

You may stop using the Service and delete your account at any time. Upon termination, the rights granted to you under these Terms will end, while provisions that by their nature should survive (including ownership, disclaimers, limitation of liability and governing law) will remain in effect.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the Service will meet your requirements, that content (including third-party metadata and ratings) is accurate or complete, or that defects will be corrected. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

To the maximum extent permitted by law, Moventra and its suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of the amounts you paid us in the twelve months preceding the claim or fifty euros (€50). Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

You agree to indemnify, defend and hold harmless Moventra and its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your use of the Service, your User Content, or your violation of these Terms or of any law or third-party right.

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, provide additional notice (for example, by email or an in-app notice).

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. The courts of the Netherlands shall have jurisdiction over any dispute, except where mandatory consumer-protection law grants you the right to bring proceedings in your country of residence.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform.

We offer Moventra as an Android application through the Google Play Store (https://play.google.com/store/apps/details?id=com.moventra). The app is a trusted wrapper around the Service and your use of it is subject to these Terms and our Privacy Policy.

When you obtain the app from Google Play, your download and use are also subject to the Google Play Terms of Service. The app store is not a party to these Terms and is not responsible for the Service or its content.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Moventra regarding the Service.

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control (force majeure).
